I have been granted to see my available service credits but was denied to see or to take a photo of my leave credit history(used/earned). I have doubt as to the integrity of our administrative office to properly apply the rules regarding leave and they had history of wrongfully deducting leave credits when they have personal issues with certain employees. They said that I need to follow the process showed in EO 2 s2016. Should the EO 2 s2016 be used as a valid reason to delay or refuse access of MY OWN personal records even if I have an ID presented? Please enlighten.

“Executive Order (EO) No. 2, s. 2016 is the enabling order for FOI. EO 2 operationalizes in the Executive Branch the People’s Constitutional right to information. EO 2 also provides the State policies to full public disclosure and transparency in the public service.

“EO 2 is an important enabling mechanism to promote transparency in the government's administrative process. Through FOI, citizens are empowered to make a formal request to get information held by the government, barring certain sensitive and important data related to the nation's security. FOI complements continuing proactive information disclosure efforts where agencies are duty-bound to publish information in the spirit of openness and transparency. ( www.foi.gov.ph ) “

The following information may be requested through FOI:

SECTION 1. Definition. For the purpose of this Executive Order, the following terms shall mean:

(a) “Information” shall mean any records, documents, papers, reports, letters, contracts, minutes and transcripts of official meetings, maps, books, photographs, data, research materials, films, sound and video recording, magnetic or other tapes, electronic data, computer stored data, any other like or similar data or materials recorded, stored or archived in whatever format, whether offline or online, which are made, received, or kept in or under the control and custody of any government office pursuant to law, executive order, and rules and regulations or in connection with the performance or transaction of official business by any government office.

The FOI covers requests by third persons of information from the Executive branch pertaining to its performance or transaction of official business by said office, simply put, to promote transparency in the government’s administrative process. Considering that the requested information is your personal record, the provisions of FOI may not be relevant to your request.
