hi.

Where can I file a complain.
a senior and sick person, advised for heart surgery is processing her papers abroad for further treatment plan. the papers need to be apostilled. she's been asked to come back for the third time now because of additional documents to be submitted or SPAs. My concern is that, these were not indicated on the dfa website, and why did they not tell these to her on her 1st or second meet up to the dfa office?

I have been calling the dfa office but they are not answering the call (calling from outside the Philippines).

The dfa is exhausting the people and the senior/ priority lane has been totally abolished.

please help.

Under Rule III, Section 4, Paragraph 2 of the Implementing Rules and Regulations (IRR) of RA No. 6713, Code of Conduct and Ethical Standards for Public Officials and Employees, each department, office or agency shall develop a service guide or its functional equivalent which shall be regularly updated and made available to the transacting public. A workflow chart showing procedures or flow of documents shall likewise be posted in conspicuous places in the department, office or agency for the information and guidance of all concerned.

This is the so called Citizen’s Charter wherein agencies are required to outline its services, process flows, documents required, and corresponding fees, among others, for the guidance of the transacting public.

Administrative proceedings for violation of RA No. 6713 and its IRR shall be in accordance with Civil Service Law and Rules.

Under Section 11 the 2017 Rules on Administrative Rules on Administrative Cases in the Civil Service (2017 RACCS), the requisites for a valid complaint are, as follows:

Section 11. Requisites of a Valid Complaint. No complaint against an official or employee shall be given due course unless the same is in writing, subscribed and sworn to by the complainant. In cases initiated by the proper disciplining authority or an authorized representative, a show cause order is sufficient.

The complaint shall be written in a clear, simple and concise language and in a systematic manner as to apprise the person complained of, of the nature and cause of the accusation and to enable the person complained of to intelligently prepare a defense or answer/comment. Should there be more than one person complained of, the complainant is required to submit additional copies corresponding to the number of persons complained of.

The complaint shall contain the following:

a. full name and address of the complainant;

b. full name and address of the person complained of as well as his/her position and office;

c. a narration of the relevant and material facts which shows the acts or omissions allegedly committed;

d certified true copies of documentary evidence and affidavits of his/her witnesses, if any; and

e. certification or statement of non-forum shopping.

The absence of any of the aforementioned requirements may cause the dismissal of the complaint without prejudice to its refiling upon compliance with the same.

Under Section 9 of the 2017 RACCS, the disciplining authorities of agencies shall have original concurrent jurisdiction with the Commission over their respective officials and employees. Hence, a complaint for violation of RA No. 6713 or its IRR may be lodged before the DFA or the CSC.
