Dear Mr. Balot

Once an appeal has been filed, it is ministerial on the part of the agency head/disciplining authority to act on it in with a reasonable period of time. In case however that the agency head/disciplining authority refuses to act on it, the aggrieved party may file an administrative case against said official.

As regard your contention that your appeal has been referred to the Commission for legal opinion, again the Commission would like to inform you that it does not render opinions or rulings on issues that may eventually be the subject of court litigation or appeal before it.

In addition, copy of the Commission’s opinion is given only to the requesting party.
