We are all aware that nepotistic “inspired” appointments, promotions and other human resource actions are anathemas to public service truth being that these are nesting grounds to breed corruption, and same is true to favoritism and cronyism. I feel dismayed that despite of the law proscribing nepotism, this condition is prevalent, a cancer waiting to be eradicated permanently most specifically in government-controlled hospitals. Some despotic people with mistaken “sense of entitlement” not only circumvent but also violate the law on its face. This results in demoralization of the ranks which leads to poor delivery of health services to the public. From the minds of the Commission, what proactive measures, programs or safety-nets have been put in place to stop the proliferation of nepotistic appointments and promotion in government hospitals? Well, we know that medical practitioners are exception to the rule, however this legal loophole is abused specifically if relatives hold sensitive positions at the same time resulting to wield power over anything and everything from procurement to hiring to decision-making that ranks normally dismiss borderling as self-serving. Does the principle “what cannot be done directly should not be done indirectly” apply in nepotism?

Dear Mr. Duke:

Pursuant to Section 125 of the 2017 Omnibus Rules on Appointments and Other Human Resource Actions (ORAOHRA), the following are exempted from the operation of the rules on nepotism:

a. persons employed in a confidential capacity
b. teachers
c. physicians
d. members of the AFP
e. science and technology personnel
f. other positions as may be provided by law.

Based on the foregoing, for medical related positions, it is only the appointment of physicians that is exempt from nepotism and not all medical practitioners. Said exemption of physicians from the rule on nepotism is provided for by law, specifically Executive Order No. 292 (Administrative Code of 1987).
