Sir/Maam:

Greetings!

The Pintuyan National Vocational High School, Pintuyan, Southern Leyte would like to ask legal basis or CSC opinion from your good office regarding the Civil Service Rules and Procedures with the following issues and concern;

Premise:
The PNVHS Teachers is required to attend the Daily Flag Ceremonies except for the Non-teaching personnel which is required only every Monday. Our School is implementing the Biometric System for TIME-IN & OUT since 2015 and at the same time requiring them to record in the LOG-BOOK and DTR reflecting the correct time specified in the Biometric facility.

At the end of the month, those who have recorded UNDERTIME based on the data generated in the Biometric System Facility, its accumulated minutes of undertime will be deducted against their Service Leave Credit. But for those who do not have a service credit, salary deduction will be observed.

Issue #1:
It was officially known by the undersigned and other concern key officials that some of our teachers and employees habitually have no biometric data in the TIME-IN but have only the recorded TIME-OUT. According to hearsay information they intentionally not to register during the TIME-IN so that the biometric system will not determine the time of arrival. By and large, UNDERTIME is silent.
However, based on the examination in the Daily Logbook and DTR for those who have no record in the biometric facility, it appears that they are not tardy or latecomers.

Question # 1:
May i know how many minutes to be deducted by the teachers and employees who failed to observe the TIME-IN requirements? What will be the legal basis?

Issue # 2
Friday Sickness. Every Friday afternoon some of our teachers and employees render the TIME-OUT from 3:30 to 4:00 for them to travel outside the town. The official time required by the teachers and employees in the afternoon is 1:00 to 5:00 PM. With this scenario, UNDERTIME policy is implemented.

Question # 2:

What will be our disciplinary action with these teachers and employees who habitually committed the UNDERTIME in the required service hours?

Issues # 3:
Some of our teachers and employees are elected officers in LS-MPC formerly PNVS-MPC. Apparently, there were instances that some of our teachers reporting to the LS-MPC office for a short period of time during office hours just to transact business. Another scenario was that some of our teachers and employees failed to participate in the district wide or school base training and seminars held during Saturday due to the conflict task of schedule required by the cooperative. Meaning, they priorities the cooperative activities attendance rather than in the Deped Activities held during Saturdays.

Question # 3:

What will be our legal sanction against our teachers and employees who failed to attend Deped Activities during Saturdays because of their attendance in the cooperative affair?

General Question:
What will happen to the School Head who failed to implement the prescribed sanctions based of the Civil Service Rules and Procedures to the teachers and employees who made infractions to the rule?

Please note that as a matter of policy, the CSC-Office for Legal Affairs (OLA) refrains from rendering categorical opinion on matters and issues that may later on be the subject of an administrative proceeding before the Commission either via an appeal or a complaint. This is to preclude the possibility of prejudgment should an actual administrative case be commenced or instituted based on the said matters or issues.

Be that as it may, please refer to CSC MC No. 21, s. 1991 (Policy on Government Working Hours for Government Officials and Employees) to be guided on proper recording of Attendance, particularly timing in and out of the office.

As regards intentional mis-declaration or non-declaration of the correct “time-in” and/or “time-out” please note that the same is a ground for dishonesty and/or such other administrative offense as the case may warrant. As such, administrative disciplinary proceedings may be instituted against the erring employee pursuant to the 2017 Rules on Administrative Cases in the Civil Service (2017 RACCS) or DepED Order No. 49, s. 2016, as the case may be.

On your query regarding the failure of teachers and employees to attend DepED activities during weekends, please refer to Rule XVII of the Omnibus Rules Implementing EO No. 292 and other Pertinent Civil Service Laws which provides for the regular hours of work required from each Government employee. Nevertheless, an employee may be administratively charged for refusing to obey a valid Order.
